Agreement, operator, and eligibility

Phoenixa is operated by Mustafa Alam, an individual based in California, United States (“Phoenixa,” “we,” “us,” or “our”). By accepting these Terms or using Phoenixa, you enter into an agreement with Mustafa Alam and agree to these Terms and the Privacy Policy. You must be at least 18, use your own verified account, and have legal capacity to agree. Do not create an account for, share access with, or submit personal information about a minor.

Service availability

Phoenixa may change, improve, suspend, or remove features. Software can contain errors or become temporarily unavailable. Do not rely on Phoenixa for emergencies, safety monitoring, medical treatment, or any decision where an error could cause serious harm.

General coaching only

Phoenixa Coach provides general goal, habit, motivation, planning, and life-organization information. AI output may be inaccurate, incomplete, biased, outdated, or unsuitable for you. Verify important information and consult a qualified professional for medical, mental-health, legal, financial, or other high-stakes decisions.

Emergencies and crisis support

Phoenixa does not continuously monitor conversations and cannot dispatch help. In the United States, call 911 for immediate danger or call or text 988 for suicide and crisis support. Outside the United States, use local emergency or crisis services. Read our AI Safety Center.

Phoenixa Group

Messages and photos posted in Phoenixa Group are shared with all group members. Members can like, save, or reshare content they can see. Participate respectfully and do not post private information about another person. Phoenixa may review reports and remove content, restrict features, or suspend accounts to protect users, enforce these Terms, or comply with law, but does not promise to monitor every post.

Acceptable use

You may use Phoenixa for lawful personal use. You may not:

• Seek or distribute instructions facilitating self-harm, violence, abuse, exploitation, illegal activity, dangerous conduct, or evasion of safeguards.
• Harass, threaten, sexualize, impersonate, or violate another person’s privacy or rights.
• Use a minor’s information, share your account, probe security, disrupt the service, automate excessive requests, or attempt to obtain secret credentials.
• Present AI output as professional advice, a diagnosis, guaranteed fact, or a guaranteed result.
• Copy, resell, or commercially exploit Phoenixa except as allowed by law or written permission.

Your content and feedback

You keep your rights in content you submit. You give Phoenixa a limited, nonexclusive license to host, copy, process, transmit, and display that content only as needed to operate, secure, moderate, and improve the service as described in the Privacy Policy. Group content may be displayed to other Group members. This license ends when the content is deleted except for temporary backups, legal records, or copies another member independently retained. Do not submit content you lack permission to use. Feedback may be used to improve Phoenixa without payment, but private conversations or your identity will not be published as testimonials without permission.

External services

App and device connections are currently shortcuts unless expressly stated otherwise. External services, websites, devices, and content are controlled by their providers. Their terms, privacy practices, availability, fees, and actions are not controlled by Phoenixa.

Push reminders

Push reminders are optional convenience features, not emergency or safety services, and delivery is not guaranteed. Browser or device permissions may be required, and you can turn reminders off at any time in Phoenixa or your device settings.

Free and Premium plans

Phoenixa Free is available without a payment card and includes one Vision, up to three Daily Missions, ten Coach messages per day, Focus Mode, up to three daily reminders, basic progress tracking, the ability to earn stars, and connected app and device shortcuts, including custom shortcuts. Animal avatars are not included with the Free plan. Phoenixa Premium costs $14.97 USD per month or $119.64 USD per year. The annual price is equivalent to $9.97 per month and is approximately 33% lower than paying the monthly price for 12 months. Premium adds unlimited Visions, unlimited Daily Missions, unlimited access to Phoenixa Coach, unlimited daily reminders, Phoenixa Group, access to every animal avatar, and advanced progress insights. Focus Mode and connected app and device shortcuts are included in both plans. Plan features and limits are shown before purchase.

Billing, renewal, cancellation, and refunds

Premium is sold and billed by Lemon Squeezy, acting as Merchant of Record for the transaction. Before checkout opens, Phoenixa clearly presents the recurring price, billing frequency, automatic-renewal terms, and cancellation method and requires separate affirmative consent. Lemon Squeezy again presents the final transaction terms before purchase. A subscription renews automatically at the selected monthly or annual interval at the price and currency disclosed at checkout until cancelled. You can cancel online at any time through Manage Billing in Phoenixa or Lemon Squeezy’s customer portal without calling or mailing us. Cancellation stops future renewals; Premium remains available until the end of the paid billing period unless a refund or applicable law requires otherwise.

Lemon Squeezy provides a retainable purchase confirmation and handles taxes, invoices, payment methods, chargebacks, and refunds under the checkout terms shown at purchase. Phoenixa or Lemon Squeezy will provide renewal, promotional-period, annual-plan, material-change, and price-change notices when required by applicable law. Refund requests may be submitted through Lemon Squeezy or support@phoenixa.coach; eligibility depends on the transaction terms and nonwaivable consumer law. Phoenixa and Lemon Squeezy retain transaction and consent records as required to provide the subscription and comply with law. Nothing in these Terms limits refund or cancellation rights that cannot legally be waived. Phoenixa does not receive or store full payment-card details.

Access and termination

You may stop using Phoenixa, delete your Phoenixa data, and sign out at any time. We may limit or end access for safety, security, misuse, legal obligations, or service changes. Ending your Phoenixa account does not automatically cancel an active Premium subscription; cancel it through Manage Billing first. Sections that logically continue after access ends continue to apply.

No warranties

To the extent permitted by law, Phoenixa is provided “as is” and “as available,” without promises that it will be accurate, safe for every circumstance, uninterrupted, secure, or fit for a particular purpose. Nothing here removes consumer rights that cannot legally be waived.

Responsibility and limits

You remain responsible for your choices and conduct. To the fullest extent permitted by law, Phoenixa is not responsible for indirect, incidental, special, consequential, exemplary, or lost-data damages. To the fullest extent permitted by law, Phoenixa’s total liability arising from the service will not exceed the greater of $100 USD or the amount you paid for Phoenixa during the 12 months before the event giving rise to the claim. These limits do not apply to responsibility or consumer rights that applicable law does not allow us to exclude or limit.

Governing law and disputes

These Terms are governed by California law, without regard to conflict-of-law rules, except where the law where you live gives you protections that cannot be waived. Before filing a claim, please contact us so we can try to resolve the issue informally. You may also use any court, agency, or consumer process available to you under applicable law.

Changes

We may update these Terms and will update the version and effective date. Material changes may require renewed acceptance. Price changes will be communicated before they affect a future renewal where required by law.
